Guard Tour Log — Terms of Use (End User License Agreement)

These Terms of Use ("Terms") are a legal agreement between you ("you", "user") and Plainside Labs ("Plainside Labs", "we", "us") governing your use of the Guard Tour Log mobile application ("the App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

These Terms also govern Guard Tour Log Team ("Team"), our paid web service and subscription for security companies, including the web dashboard at app.guardtourlog.com. By subscribing to or using Team, you agree to these Terms. References to "the App" include Team where the context allows.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control, for your personal or internal business use, in accordance with these Terms and the applicable app store's terms.

2. Distribution and app store terms

The App is distributed through Google Play. Your use is also subject to Google Play's terms and policies. If any conflict arises between these Terms and the app store's terms regarding distribution, the app store's terms govern that aspect.

3. The App is a tool — no guarantee of outcomes

The App helps you scan checkpoints, log shifts, and record incidents. It is a record-keeping tool only. It does not provide security services and does not guarantee any safety, security, or compliance outcome. You remain solely responsible for your duties, conduct, and decisions on shift.

We do not warrant that records, timestamps, GPS coordinates, or PDF reports produced by the App will be accurate, complete, or accepted as official or legal evidence by any employer, client, court, or authority. GPS and time data depend on your device and environment and may be unavailable or imprecise (for example, indoors). Do not rely on the App as your sole record where accuracy is critical.

4. Your data and your device

The App stores your data locally on your device. We do not host, back up, or have access to it. You are responsible for:

• the security of your device and the data on it;
• exporting and backing up any reports you need to keep;
• any loss of data resulting from device loss, damage, reset, or uninstalling the App.

We are not liable for any loss of data stored locally.

If you use Team, the information needed to provide it — your account, activated guard devices, company branding, and a record of which reports were delivered to your connected Google Drive — is processed on our servers. Report files are delivered to your own Google Drive.

5. Acceptable use

You agree not to:

• use the App for any unlawful purpose or in violation of any applicable law or regulation;
• reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law;
• interfere with or disrupt the App, or attempt to gain unauthorized access to it;
• misrepresent records created with the App or use it to deceive;
• use the App to commit fraud or send spam, infringe anyone's intellectual property, introduce malware, or probe, scan or scrape the App or its servers.

You are responsible for complying with all laws that apply to you, including any rules on recording, photography, location tracking, and data handling in your jurisdiction and at the sites you patrol.

6. Intellectual property

The App, its content, design, and the "Guard Tour Log" and "Plainside Labs" names and logos are owned by or licensed to Plainside Labs and protected by applicable laws. These Terms grant you a license to use the App, not any ownership rights. Other names or brands referenced are the property of their respective owners.

7. Pricing, Team subscriptions and billing

The mobile App is free to download and use. Team is a paid subscription.

• Paddle is the merchant of record. Team is sold and billed by our online reseller Paddle.com, which processes payments, issues invoices and handles applicable taxes. Your purchase is also subject to Paddle's Buyer Terms.
• Price. Team is billed monthly, and the price depends on the number of guard seats you choose. Current prices are shown on our Pricing page and at checkout.
• Renewal. Your subscription renews automatically each month until you cancel it.
• Cancellation. You can cancel at any time using the subscription controls in your Team dashboard or by contacting us. Cancelling stops future renewals; Team stays active until the end of the period you have already paid for. Cancelling does not retroactively refund earlier payments.
• Refunds are covered by our Refund Policy.
• Non-payment. If a payment fails or is not made, we may suspend or terminate your access to Team.

8. Third-party services

The App may use Google Play services, including Google Play In-App Review. These are provided by Google under Google's own terms and policies.

9. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any defects will be corrected.

10. Limitation of liability

To the maximum extent permitted by law, Plainside Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising out of or related to your use of, or inability to use, the App — even if advised of the possibility. To the extent liability cannot be excluded, it is limited to the amount you paid for the App (which may be zero).

11. Termination

These Terms apply until terminated. Your license ends automatically if you breach them. You may end them at any time by uninstalling the App. Sections that by their nature should survive (including IP, disclaimers, and limitation of liability) survive termination.

We may suspend or terminate your access to Team for a material breach of these Terms, non-payment, a security or fraud risk, or repeated or serious violations of these Terms.

12. Changes

We may update the App or these Terms from time to time. Material changes will be reflected by an updated effective date. Your continued use of the App after changes means you accept the updated Terms.

13. Applicable law

Nothing in these Terms limits any rights you have under laws that apply to you and cannot be excluded by agreement, including mandatory consumer protection laws. If you have a concern or dispute about these Terms, the App or Team, please contact us first so we can try to resolve it.
